Terms of use
Before using the Service, read the terms of the Rules. The fact of using the Service in any way is recognized as acceptance, that is, the User’s full and unconditional consent to use the Service under the conditions set out below.
- General provisions
- These rules (hereinafter referred to as the “Rules”) define the terms of use of the help me clinic Information Retrieval Service, the rights to which belong to its creators (hereinafter referred to as the “Owner of the Service”).
- The help me clinic Information Retrieval Service (hereinafter referred to as the “Service”) for the purposes of these Rules means a software product, access to which is provided on the website at helpmeclinic.com , designed to search for and provide the User with information about the services of medical organizations based on his requests; tracking and providing the User with, who subscribed to the mailing list of the Service, statistical, educational and advertising information of third parties; providing the User who has registered on the Service with the opportunity to personalize the functionality of the Service, including saving the data specified by the User and the settings of the Service functions.
- The User expresses his full and unconditional consent that the use of the Service, as well as any of its parts, in any way implies the fact that the User is familiar with these Rules and means full and unconditional agreement with their content. If the User does not accept the terms of the Rules in full, the User is obliged to refrain from using the Service.
- These Rules and all relations related to the use of the Service are subject to the law of the Republic of Belarus. Any claims or lawsuits arising from these Rules and or the use of the Service must be filed and considered in court at the location of the Owner of the Service.
- If for any reason one or more provisions of the Rules are declared invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Rules.
- The Privacy Policy is an integral part of these rules and their part.
- Using the Service
- The Owner of the Service grants the User a non-transferable right to use the Service on the territory of all countries of the world for its direct functional purpose, defined in clause 1.2. of the Rules.
- Interaction with the Service, including the formation of User requests to search for information about the services of medical organizations, is carried out exclusively by means of the graphical interface of the Service provided to Users. By means of the Service, the User is given the opportunity to get acquainted with information about the services of medical organizations, contact them, and also get links to go to the websites of these third parties. The links provided by the Service to any third-party website, product, service, any information of a commercial or non-commercial nature do not constitute an endorsement or recommendation of these products (services, activities, persons) by the Owner of the service.
- The User is notified and confirms the understanding of the fact that the Owner of the service is not responsible for medical organizations and the information provided by them, as well as for the actions of other Users of the Service. In case of disputes, the User undertakes to apply for their resolution directly to persons who have entered into a relationship with the User to provide relevant services, transfer funds, etc.
- The User is informed and agrees to refrain from the following actions:
- interfere with the operation of the Service in ways that may result in a violation of its operability, including forming requests otherwise than through the user interface;
- use any programs or applications not authorized by the Owner of the Service to interact with the Service;
- carry out modification, improvement, translation into other languages, decompilation, disassembly, decoding, emulation, integrity violation, restoration of the source code of the Service or any of its parts;
- use the Service for illegal purposes.
- The Owner of the Service at any time, at his discretion, has the right to terminate support for the operability of the Service, change its functionality, as well as prohibit the User from using the Service, and the User is obliged to comply with this prohibition at the specified request.
- By means of the Service, the User is given the opportunity to subscribe and receive the newsletter of the Service by e-mail. The User agrees that the registration and/or use of the corresponding subscription by the User is regarded as the User’s consent to:
- using the User’s email address to send the User and receive the corresponding letters from the Owner of the service;
- receiving advertising information integrated into the mailing list of the Service Owner and third parties (third-party advertisers);
- If the User does not agree with the rule specified in this paragraph, the User is obliged to refuse to receive the newsletter by clicking on the corresponding link available in each letter.
- By means of the Service, the User is given the opportunity to personalize the functionality of the Service for his own needs, the User agrees that the fact of registration (authorization) of the User on the Service and the use of the account assigned to the User on the Service is regarded as the User’s consent to the processing of account data for the purposes defined in clause 1.2. of the functioning of the Service.
- Responsibility
- The functionality of the Service is provided on an “as is” basis. The Service Owner does not provide any guarantees regarding the error-free and uninterrupted operation of the Service, its individual parts, components or functions, the compliance of the Service functionality with specific goals and expectations of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the data provided by the Service, and also does not provide any other guarantees not expressly specified in these Rules.
- The Service Owner is not responsible for any direct or indirect consequences of any use or inability to use the Service (including data) and /or damage caused to the User and /or third parties as a result of any use, non-use or inability to use the Service (including data) or its individual components and/or functions, including due to possible errors or failures in the operation of the Service.
- The User undertakes to use the Service in accordance with the laws of the country in which he is located, and assumes responsibility for violating the restrictions on the use of the Service established by national legislation.
- The User is solely responsible to third parties for his actions related to the use of the Service, including if such actions lead to a violation of the rights and legitimate interests of third parties, as well as for compliance with applicable legislation when using the Service.
- In case of any disputable situations, the User, before applying to the judicial authorities for a dispute resolution, is obliged to take measures for a pre-trial resolution by sending a corresponding letter to the address of the Service Owner, as well as an electronic copy of it to: support@helpmeclinic.com
- Rights to the Service
- Intellectual property rights, including the results of intellectual activity included in the Service or used by it, such as texts, images, design, databases, know-how, trademarks, trade names and other means of identification, etc., belong to the Owner of the service or are provided to him by the copyright holders under license.
- The use of the intellectual property objects specified in clause 4.1. is possible only within the framework of the functionality offered by the Service. The User agrees that the use of the Service does not grant him any rights in relation to these intellectual property objects, except for the rights explicitly specified in the Rules.
- Changing the rules
- The Service Owner has the right to change these Rules unilaterally at any time and without prior notice.
- Changes to the Rules come into force from the date of their publication, unless otherwise specified in the relevant publication.
